OpenBid Terms of Use
Last updated: 18th July 2025
1. Independence for Drivers. Choices for Passengers
OpenBid is a platform that connects independent drivers and passengers. Passengers submit ride requests by proposing a fare, and drivers may either accept or counter the offer. Once agreed, the two parties form a separate service contract. OpenBid is not involved in fare negotiations, settlements, or the resulting service contracts.
All pricing agreed upon via the platform is inclusive of fees, tolls, and taxes. OpenBid serves purely as a technology intermediary and does not provide transportation services directly.
2. Your OpenBid Account
To use OpenBid, you must register an account and be at least 18 years old. Drivers must undergo additional verification steps. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. Notify us immediately if you suspect unauthorized use.
You may delete your account anytime through the app. Inactive accounts may be removed after 3 years of non-use.
3. Safety First
OpenBid takes safety seriously. All drivers undergo verification and may be subject to identity checks. Passengers should confirm the driver's identity before beginning a trip. We urge users to act with caution and report suspicious behavior using the in-app "SOS" function.
4. Responsibilities of Drivers
- Hold a valid driver's license and legal authority to operate the vehicle.
- Use only the vehicle registered with OpenBid for services.
- Not operate under the influence of drugs, alcohol, or while fatigued.
- Respect passenger safety and privacy.
- Comply with all relevant tax, safety, and anti-money laundering regulations.
5. Communication Rules
Users must only communicate via OpenBid for ride-related purposes. Any harassment, spamming, or post-trip contact (except for lost items) is prohibited. OpenBid may monitor communications to enforce this policy.
6. OpenBid Communications
We may send you service updates, transaction notifications, or promotional content. You can opt out of non-essential marketing messages at any time as per your regional laws.
7. Prohibited Conduct
- Engaging in illegal or harmful behavior through the platform
- Attempting to manipulate fare mechanisms or fake user activity
- Using unauthorized third-party tools or modifications
- Impersonating another person or creating fake accounts
- Uploading offensive, illegal, or infringing content
8. Platform Enforcement Rights
OpenBid may suspend or terminate accounts that violate these Terms. This includes fraudulent activity, policy abuse, or technical manipulation. We reserve the right to investigate and act at our sole discretion.
9. User Content
You retain ownership of your content but grant OpenBid a license to use, reproduce, and adapt it to operate and improve the platform. Content that violates laws or harms others may be removed.
10. Intellectual Property
The OpenBid platform and all associated intellectual property are protected by law. You are granted a limited, personal license to use the platform. You may not reverse-engineer, redistribute, or reproduce our systems or content without written consent.
11. Indemnity
You agree to defend and indemnify OpenBid against any claims, damages, or losses arising from your misuse of the platform, violation of these terms, or legal breaches.
12. Limitation of Liability
To the maximum extent allowed by law, OpenBid disclaims liability for indirect, incidental, or consequential damages related to your use of the platform. We are not liable for service outcomes between drivers and passengers.
13. Dispute Resolution
These terms are governed by the laws of Cyprus. Disputes will first be resolved amicably, failing which arbitration will occur under the Vienna International Arbitral Centre rules.
14. Changes to Terms
OpenBid may modify these terms. Continued use of the platform indicates your acceptance of the new terms. If you disagree, you must stop using the platform.
15. General Provisions
The platform is provided "as is". We are not liable for third-party content, links, or services accessed through the app. Your legal rights under consumer law remain unaffected.
